Temporary injunctions now include all schools located in the following twenty-one states: Idaho, Indiana, Kentucky, Louisiana, Mississippi, Montana, Ohio, Tennessee, Virginia, West Virginia, Kansas, Alaska, Texas, Utah, Wyoming, Iowa, Missouri, Arkansas, Nebraska, South Dakota and North Dakota.
An additional list of specific schools spanning the entire country, including schools located in states not within the scope of state-wide injunctions, is scheduled to be filed in court tomorrow, July 26, 2024, which will add to the schools attended by members of Young America’s Foundation, Female Athletes United and Moms for Liberty.
Challenges are still pending for Alabama, Florida, Georgia, Oklahoma and South Carolina.

The Office for Civil Rights also just released guidance for schools that will remain subject to the new rules. Although the guidance does not appear to offer much in the way of substantive clarifications on specific aspects of the revised regulations, it does signal the Department appears intent on moving forward with implementation despite the wide-spread injunctions in place.
